Capital, Credit, and Treasury Management
Federal Trade Commission
Through a comment letter and subsequently in live testimony before an FTC appointed administrative law judge, successfully argued that the FTC inaccurately concluded that the rule would not have a significant impact on the economy. (Negative Option Rule)
Food and Drug Administration
Through a comment letter, quantitatively demonstrated that the relative magnitude of the proposed rule’s costs and benefits were in fact reversed once the rules effects on laboratory developed tests leaving the market were accurately measured.
Bureau of Indian Affairs
Our comment letter prompted the Bureau of Indian Affairs and the Office of Information and Regulatory Affairs to reconsider a proposed rule regarding Land Acquisitions and Class III Tribal State Gaming Compacts as not economically significant.
Securities and Exchange Commission
Our comment letter with Craig Lewis, former SEC chief economist, formed the basis for a subset of lawmaker questions for SEC officials posed in congressional hearings regarding a significant set of costs missing from the SEC’s own economic analysis of a proposed rule on position reporting on large swap positions and the costs it would impose on activist investors and corporate governance.
